Dear Biodiesel Supporter,

We are writing you today to let you know about a very important piece of biodiesel legislation making its way through the New York State Assembly. It's a bill called A09534 and it would extend a 20 cents/gallon tax credit to users of clean burning B20 Bioheat fuel.

We are asking for you to please send the attached (or your own) letter of support to your assembly member, your state senator, and Governor Spitzer. Please let them know that you support New York City's transition to clean burning biodiesel fuel in order to reduce global warming pollution, and create a healthier city. Let them know that you support A09534 and that they should too.

Dear Assembly Member,

I am writing you today to ask for your support of a timely vote and passage of proposed legislation A09534. This bill will extend the allowance of a tax credit for end users of clean burning, biodiesel blended, home-heating oil.

As your constituent and a strong supporter of biodiesel fuel here in New York, I feel that this bill will be a huge boost for creating a market for renewably produced biodiesel-heating oil (Bioheat).

As you probably know, the use Bioheat will greatly reduce the harmful emissions related to home heating, both in terms of global warming and local respiratory health. Bioheat is a domestically produced, vegetable oil based product that reduces emissions by about 75% over petroleum, and can be used in existing equipment.

Unfortunately, the Bioheat industry is young and the fuel remains slightly more expensive than normal heating oil. Because of this price disparity it has been very difficult to get home-owners sign on for Bioheat, especially in this time of high home heating prices.

This bill A09534 will be a great help to this new “green collar” industry, reduce global warming, protect the health of all New Yorkers, and assure that New York State gets back out in front with respect to this great renewable fuel.

TITLE OF BILL: An act to amend the tax law, in relation to extending the allowance of a credit related to the cost associated with replacement or renovation of a home heating system; to amend part C of chapter 35 of the laws of 2006, amending the tax law relating to providing a refundable personal income tax credit related to the cost associated with replacement or renovation of a home heating system, in relation to extending the allowance of such credit; to amend the tax law, in relation to extending the allowance of a clean heating fuel credit; and to amend part D of chapter 35 of the laws of 2006, amending the tax law relating to a clean heating fuel credit, in relation to extending the allowance of such credit

PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to promote energy efficiency and the use of clean alternative fuel by extending the allowance of related tax credits.

SUMMARY OF SPECIFIC PROVISIONS: This bill would extend the personal income tax credit allowed toward the cost of replacing a home beating system with an energy star unit for two years; and extend the tax credit for the use of bio-heat for residential home heating against the corporate franchise tax and personal income tax for four years.

JUSTIFICATION: Chapter 35 of the Laws of 2006 established these tax credits which were designed to promote energy efficiency and the use of clean alternative fuel. The maximum credit under the energy efficient heating system is $500 and is valid for the period July 1, 2006 through June 30, 2007. The bio-heat credit is calculated as $0.01 per percent of bio-diesel content per gallon purchased during the period July 1, 2006 through June 30, 2007 and cannot exceed $.20 per gallon. Enactment of this bill will prevent these important tax incentives from lapsing. In addition, the bio-heat tax credit was unable to get off the ground before the 2006-07 heating season, and unless it is extended, it will die before it has even been given a chance to stimulate the use of bio-diesel to be used as a home heating fuel oil.

PRIOR LEGISLATIVE HISTORY: Veto 115.

FISCAL IMPLICATIONS: To be determined.

EFFECTIVE DATE: Immediately and deemed to be in effect on and after July 1, 2007.
